TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the website boredmood.studio (the "Site") and the Boredmood Studios Discord community (the "Service") operated by Edward Haejun Kim LLC ("Company," "we," "us," or "our"). By purchasing access or using the Service, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years of age to use this Service. By purchasing access, you represent and warrant that you meet this age requirement and have the legal capacity to enter into a binding agreement.

2. The Service

Boredmood Studios provides access to a private Discord community focused on generative AI art education, including but not limited to tutorials, guides, presets, workflows, and peer discussion related to tools such as Higgsfield AI, Flora AI, ComfyUI, and similar technologies.

The Service is provided on a "lifetime access" basis, meaning access continues for as long as the community remains active and operational. We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice.

3. Purchase & Payment

• All purchases are processed through Polar, a third-party payment processor. By completing a purchase, you also agree to Polar's terms of service.
• The purchase price is a one-time fee as displayed on the Site at the time of purchase.
• All sales are final. No refunds will be issued. By completing a purchase, you acknowledge and agree that you are purchasing access to digital content and waive any right to a refund.

4. Access & Account

• After purchase, you will receive an invite link to join the Discord community. Access is tied to your Discord account.
• Your access is personal and non-transferable. You may not share, resell, or distribute your access credentials or invite link.
• You are responsible for maintaining the security of your Discord account.

5. Community Rules & Conduct

By joining the Service, you agree to:

• Follow all rules posted within the Discord server.
• Not engage in harassment, hate speech, spam, or any illegal activity.
• Not share, redistribute, or publicly post premium content, guides, presets, or workflows provided within the community without express written permission.
• Not attempt to reverse-engineer, scrape, or automate access to community content.

Violation of these rules may result in immediate removal from the community without a refund.

6. Intellectual Property

• All content provided within the Service (tutorials, guides, presets, workflows, graphics, branding) is the intellectual property of Edward Haejun Kim LLC unless otherwise stated.
• You are granted a limited, non-exclusive, non-transferable license to use the provided educational materials for personal, non-commercial purposes only.
• Art and content you create using the tools and techniques learned in our community belong to you, subject to the respective AI tool's terms of service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not guarantee any specific results, outcomes, earnings, or skill level from using the Service. Educational content is for informational purposes only.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, EDWARD HAEJUN KIM LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR ACCESS TO THE SERVICE.

9. Indemnification

You agree to indemnify, defend, and hold harmless Edward Haejun Kim LLC and its members, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason, including but not limited to violation of these Terms or community rules. Termination does not entitle you to a refund.

11. Governing Law & Disputes

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or the Service shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA), conducted in the State of Texas. You agree to waive any right to a jury trial or to participate in a class action.

12. Modifications

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last Updated" date. Continued use of the Service after modifications constitutes acceptance of the updated Terms.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Edward Haejun Kim LLC regarding the Service and supersede all prior agreements and understandings.
